While KW BURRIS CONSULTING, LLC, at times, utilizes products produced by third-party manufacturers and services of third-party distributors and providers, KW BURRIS CONSULTING, LLC makes no recommendations or endorsements about third-party products and services. References to and reliance upon third-party services and products are provided by KW BURRIS CONSULTING, LLC "as is", without warranty of any kind, either express or implied.

User Responsibility

You understand and agree that before KW BURRIS CONSULTING, LLC performs any services of any kind to your computer(s) or other systems, it is your responsibility to back up the data, software, information, or other files stored on your computer disks and/or drives. You acknowledge and agree that KW BURRIS CONSULTING, LLC shall not be responsible under any circumstance for any loss or corruption of data and/or software.

Liability Release

By submitting, whether written, electronic, or verbal, your Purchase Order to KW BURRIS CONSULTING, LLC, you agree to release and hold harmless KW BURRIS CONSULTING, LLC and its agents/employees from and against any loss, liability, or damage, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability that you may suffer arising out of, or related to, the services provided by KW BURRIS CONSULTING, LLC. This includes but is not limited to data loss or lack of function in any component or element of your computer system and/or peripherals.

Warranties and Disclaimers; Liability Limitations

EXCEPT AS EXPRESSLY PROVIDED OTHERWISE IN AN AGREEMENT BETWEEN YOU AND KW BURRIS CONSULTING, LLC, ALL GOODS AND PRODUCTS, INFORMATION, AND SOFTWARE ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL KW BURRIS CONSULTING, LLC BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION, THOSE RESULTING FROM: (1) RELIANCE ON THE MATERIALS PRESENTED; (2) COSTS OF REPLACEMENT GOODS; (3) LOSS OF USE, DATA OR PROFITS; (4) DELAYS OR BUSINESS INTERRUPTIONS; (5) AND, ANY THEORY OF LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF INFORMATION) WHETHER OR NOT KW BURRIS CONSULTING, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

K. W. BURRIS CONSULTING, LLC IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR YOUR INABILITY TO USE YOUR COMPUTER OR OTHER PRODUCTS OR FOR THE COMPATIBILITY OF PRODUCTS WITH ONE ANOTHER.
